NEWS AND EVENTS

  • As part of our process of assessing the amount of damages owed to the class members, we need to get in touch with any present or former homeowner who is in any of the following groups.  We are asking for this information purely for the purposes of assessing home values in the neighborhood under various circumstances.    PLEASE CONTACT US IF YOU OR ANYONE YOU KNOW ARE IN ANY OF THESE TWO GROUPS OF PERSONS:

  1. Anyone who has re-sold a home in Penn Mill Lakes Subdivision.

  2. Anyone who has purchased a home in Penn Mill Lakes Subdivision from a previous homeowner (i.e., not directly from the developers). 

  • We have finalized the upcoming meeting of the homeowners.  The CONFIRMED date is SATURDAY, JULY 10, 2010, at 10:00 AM, at the home of Mr. and Mrs. Markiewicz, at 107 Penn Mill Lakes Blvd.  Refreshments will be served.

  • We have been very busy gathering and reviewing information from the public records regarding the drainage plans, construction plans, hydrology studies, elevation maps, and other records relating to the design and development of the subdivision.  We have quite a bit to report to the homeowners, so we hope you all show up for the meeting.

  • New easier to remember web address.  We have redesigned our website.  The Penn Mill Lakes page (this page) now has a new and much easier to remember address.  To navigate directly back to this page, simply type in www.lsulawyer.com/pml into your Internet browser.

  • Our expert has reviewed the defendants’ expert’s report and has made his initial review.  Click here to read our expert’s initial report.  In a nutshell, the defendants’ report is deficient, does not account for all of the problems, and does not solve (or even address) all of the known problems.  You may need to sign up for a FREE Adobe Acrobat.com account in order to view the PDF reports.  If you do not wish to do so, you may contact Mr. Lambert to have a report emailed to you.

  • Please review the reports and email us with ANY comments, concerns, whatever.  Also, please continue to keep us updated on the goings on in the subdivision, including any flooding problems which are still occurring.  Your photos and input are of great assistance, both as evidence and as evaluation tools for our expert.  Keep those photos and videos coming!

ABOUT THE CASE

  • Purchasers of property in a newly-built subdivision suffered serious drainage issues which impeded access to their homes and affected their property values. 

  • The class alleges that the drainage system in the subdivision was poorly designed and poorly built and the entire system needs to be redesigned and rebuilt.

  • Mr. Lambert, along with his co-counsel, Maurice LeGardeur, Louis R. Koerner, Jr., and Emery Voorhies, filed suit on behalf of all of the homeowners in the subdivision to compel the subdivision developers to remedy the drainage issues and restore the plaintiffs’ property to full use.  

  • The class has not yet been certified and we are currently looking to speak with anyone who was or is a homeowner in the Penn Mill Lakes Subdivision.  If you own a home or lot in the subdivision, please contact us today without charge or obligation to discuss your options.

  • We have received several emails from homeowners in the subdivision regarding the drainage issues on their property.  We are pleased that homeowners are checking the website and keeping us informed.  The information and support you have provided has been invaluable to us.  Remember that this is YOUR suit and we are fighting for YOUR property.  Your assistance and input is necessary, welcomed, and much appreciated.

  • We have begun tentative settlement negotiations and it appears that the defendants are negotiating in good faith. Nevertheless, the defendants’ report is deficient, does not account for all of the problems, and does not solve (or even address) all of the known problems. 

  • The defendants’ expert reports were received by us on May 7, 2010.  Our expert’s initial report was received on May 14, 2010.  Both are available to you on this site, or by email by request.
