NEWS AND EVENTS

  • On April 27, 2012, the Louisiana Supreme Court denied the defendants' final writ application.  That is the end of their lengthy appeal process on the issue of the trial court's denial of their various exceptions. 

  • We have been hard at work with our expert to find solutions to the drainage problems and we believe we are nearing a solution which should be acceptable to everyone.  Our expert has not yet submitted a final report, but he has already discovered positive changes which can be made to repair the broken system.  If these changes are accepted by the parties and the parish, the result should be that everyone in the subdivision will be above the 100 year flood plain, which could also have the added benefit of lowering flood insurance rates across the entire subdivision.

  • We have had serious scheduling difficulties with depositions, but we are hoping to resolve all of these problems shortly and get the depositions done soon, with an eye towards getting the class certification done immediately thereafter.

  • PLEASE DO NOT STOP RECORDING INFORMATION ON ANY FLOODING EVENTS FOR US!  The rainy season is coming soon and we want to make certain that we know of every event in the subdivision.  Please continue to send your photos, videos, and event logs.

  • As part of our process of assessing the amount of damages owed to the class members, we need to get in touch with any present or former homeowner who is in any of the following groups.  We are asking for this information purely for the purposes of assessing home values in the neighborhood under various circumstances.    PLEASE CONTACT US IF YOU OR ANYONE YOU KNOW ARE IN ANY OF THESE TWO GROUPS OF PERSONS:

  1. Anyone who has re-sold a home in Penn Mill Lakes Subdivision.

  2. Anyone who has purchased a home in Penn Mill Lakes Subdivision from a previous homeowner (i.e., not directly from the developers).

ABOUT THE CASE

  • Purchasers of property in a newly-built subdivision suffered serious drainage issues which impeded access to their homes and affected their property values. 

  • The class alleges that the drainage system in the subdivision was poorly designed and poorly built and the entire system needs to be redesigned and rebuilt.

  • Mr. Lambert, along with his co-counsel, Maurice LeGardeur, Louis R. Koerner, Jr., and Emery Voorhies, filed suit on behalf of all of the homeowners in the subdivision to compel the subdivision developers to remedy the drainage issues and restore the plaintiffs’ property to full use.  

  • The class has not yet been certified and we are currently looking to speak with anyone who was or is a homeowner in the Penn Mill Lakes Subdivision.  If you own a home or lot in the subdivision, please contact us today without charge or obligation to discuss your options.
